New Delhi: Republican Party National Secretary-General Amb Dr Rajiv Menon has welcomed the Supreme Court’s decision that all private property cannot be taken over by governments citing public good. A nine-judge Constitution bench headed by Chief Justice DY Chandrachud modified its order allowing private land to be acquired and redistributed for public good. AMB Dr Rajeev Menon said that the supreme court’s crucial order is commendable.
The CJI pointed out that Justice Krishna Iyer’s theory speaks of a narrow economic policy in which the government has a big role to play. In 1978, Justice V.R. Amb Dr Rajeev Menon said the supreme court’s verdict that governments cannot take over all private property citing public good is one of the most important judgments of the Supreme Court. Chief Justice D.Y. Singh was referring to the decades-old legal question of whether private property should be included in the social and physical property mentioned in Article 39(b) of the Constitution. A bench headed by Justice Chandrachud replied. He said the majority judgment written by the CJI has made it clear that although a community’s material resource includes privately owned resources, it depends on the situation.
